David Walliams stepped down from judging Britain’s Got Talent last November after derogatory comments were picked up on his microphone during the auction process in January 2020.

Bosses are reportedly set to take on David after it was claimed he was suing Fremantle, the production company behind the programme.

It comes after an expletive rant he made about a contestant was leaked and he subsequently stepped down from the show.

It’s been reported the children’s author was seeking “significant damages” after leaving the show and being replaced by Strictly Come Dancing judge Bruno Tonioli.

David allegedly accused Fremantle of a “data protection breach over the leaked transcript” and lodged papers at London’s High Court last Thursday.

It has now been claimed Britain’s Got Talent chiefs have said David “knew” his vile words could have been aired.

“There has been much back and forth between David and Fremantle for the last ten months, since he was sacked from BGT,” a source told MailOnline.

“He is saying that Fremantle breached his data rights but he was made well aware two years before he made the comments that they could be put out into the public domain.”

They continued: “It was a change to the show which was widely publicised to viewers, the press and the judges.”

They claimed a freelance worker leaked the transcript and could have been “someone who didn’t like David very much”.

Britain’s Got Talent and Fremantle have been contacted for comment by Express.co.uk.

It has also been claimed that a press release “seen” by David and the rest of the judges stated their off-mic chats could be made public at Fremantle’s discretion.

Within the leaked transcript the comedian could be heard calling an elderly auditionee a “c***” three times and said of another: “She thinks you want to f*** her, but you don’t,” whilst he thought his microphone was off.

David said in an apology: “I would like to apologise to the people I made disrespectful comments about during breaks in filming for Britain’s Got Talent in 2020.

“These were private conversations and – like most conversations with friends – were never intended to be shared. Nevertheless, I am sorry.”

Britain’s Got Talent returns to ITV later this year on a date yet to be announced.
